Stolen pictures !
A few months ago, by accident, I discovered that a picture of mines, that I posted on T.E. was used without permission on this site : http://www.oliviermessiaen.org/messiaengall.htm
I sent the webmaster an e-mail to say that he didn't ask my permission and insisted for a payment. He wrote me the following words : Dear Luc de Baets Thank you for the email. Firstly may I say that I always try to seek permission for the display of photographs on the Olivier Messiaen web site out of courtesy. However, this photo was seen on a site (Trekearth) that had no contact details and since the images were not 'locked' I naturally assumed that to display the photo on the Olivier Messiaen site would be ok as it amounts to free publicity and exposure of your work. Furthermore, my lawyers have noted that the Olivier Messiaen web site is a non commercial, non profit making and purely educational web site where nobody is making any financial gain therefore no financial contracts need be entered into. All the photographers whose photos appear on the web site have been very grateful for the exposure of their work to a different audience and I'm sorry that you don't feel the same way. I will withdraw the photo forthwith to comply with your wishes. with kind regards Malcolm Ball In this gallery there where also some shots of Alain Herrault. The shots were removed a few days later, but now I see that there are some shots of "La Meije" in France. I thought I have seen these shots before on T.E., but I can't remember from who... Maybe one of you could recognize them ? If so, I would give the photographer the advice to react on it.

They even dare mention this "Copyright exists on all of these photographs.
Downloading and electronic reproduction of any image is illegal without the express permission of the copyright owner."!!!! While they are doing what they don't want other people to do!!!

I am pretty sure that this behaviour is used to prevent from further studies and any payment. I am missing anything which is more than an email adress, but I find a lot which must be seen as advertisement.
A "who is" research told me that he is based in GB and also the registrant of the site, no other owner there. So he is responsible and based in GB, has to follow this laws, which now copyright very well. Ulf

His lawyer is either crap or well paid.
(if none of the above, then they're married). Just tell him your lawyer will contact his, together with the bill. As if non profit organisations never have to pay a bill. If that is true I will start one and tell Bentley to lent me one of their cars for a few years. I will use his lawyer to explain that everything I do goes without pay. Because I'm non commercial. Does anybody know where to find mrs. Ball? (for free that is)

Le problème des photos volées semble récurent sur TE! Il semble facile en effet aux gens dénués de tous scrupules de se procurer des photos gratuites dans cette fantastique base de données que représente TE, ils peuvent ainsi illustrer leur sites de voyages ou découvertes gratuitement! Ceci ne me gènerait pas outre mesure, même si je trouve le procédé un peu cavalier, mais ce qui m'ennuie plus c'est que des membres iminents de TE ont quitté le site à cause de cela, et nous sommes privés maintenant de leurs merveilleuses photos! Alors n'y aurait-il pas quelquechose à faire? Je sais que TE est un site de partage, mais ne pourrait-on pas appliquer un copyright sur les photos publiées de sorte qu'elles soient protégées et impossible à voler? Ne pourrait-on pas échanger uniquement entre membres de TE? Quelle solution pour régler ce problème?
Merci aux francophones d'échanger sur ce sujet sur ce site d'obédience anglophone.

Salut Christian,
il est techniquement impossible d'empêcher la copie de photos depuis le net... j'ai moi même trouvé une des miennes sur une site... mais n'ai meme pas pris la peine de contacter le coupable... je pense le faire sous peu...
